We have recently received a number of calls from people living in the Somerset, Middlesex and Union County areas who have received notification that a creditor, more often than not a credit card company or a debt buyer, has made application to the court for a Wage Garnishment or Bank Account Levy.
New Jersey Statutes and Court Rules allow a creditor who has obtained a judgment to make application to the Court for a special form of Order allowing the creditor to have a Court Officer or Sheriff to seize a portion of a paycheck or the contents of the bank account to satisfy the Judgement.

The New Jersey Law Journal recently reported that a consumer law firm has made application to challenge collection litigation brought on by a debt buyer known as LVNV Funding LLC on the grounds that they are not properly licensed in New Jersey and therefore their actions are in violation of the New Jersey Consumer Finance Licensing Act.
It will take some time for the New Jersey Courts to sort out whether or not this particular debt buyer is legally permitted to bring collection actions in New Jersey.
